Navigating Vaping Reforms

The Therapeutic Goods and Other Legislation Amendment (Vaping Reforms) Act 2024, introduces significant changes to vaping regulations. 

 

Vapes containing nicotine or zero-nicotine substances will require a prescription until 30 September 2024, with supply restricted to pharmacies. From 1 October 2024, vaping products with nicotine concentrations of 20 mg/mL or less can be supplied without a prescription, subject to pharmacist assessment and guidance. From 1 October 2024, a prescription will still be required for patients wishing to access a vape greater than 20mg/mL or for a patient aged under 18 years. 

 

Pharmacists will play a pivotal role in supplying therapeutic vapes and offering guidance on managing nicotine dependence and harm reduction strategies. It is anticipated that pharmacists may face increased demand for managing nicotine dependence and from consumers who use vapes recreationally.

   

The Pharmaceutical Society of Australia is facilitating a series of webinars and interactive workshops to help pharmacists to understand their obligations and support pharmacists to deliver treatment of nicotine dependence in this new model of care.

Navigating Vaping Reforms – Webinars

This series of three expert-led webinars will empower pharmacists with comprehensive knowledge and practical guidance on navigating legislative changes, including their evolving role in providing nicotine cessation therapy and vaping cessation guidance.

  

This series aims to equip pharmacists with insights into the public health impacts of the reforms, clarify ethical and liability considerations in prescribing and dispensing vapes, and outline PSA’s strategic plan for supporting pharmacists adapt to this new model of care over the next 12 months.

Mandy Edlington 
Acting Assistant Secretary Vaping Legislative Reform Branch

 

Mandy Edlington is the Acting Assistant Secretary of the Vaping Legislative Reform Branch at the Therapeutic Goods Administration (TGA) in the Australian Government Department of Health and Aged Care.

 

She has worked in the Department since 2016, during which time Mandy has managed the provision of legal advice on matters of statutory interpretation, administrative law, legislative design and drafting, dispute resolution and enforcement action. Notably, she contributed significantly to the Department’s emergency response to COVID-19 and Australia’s first onshore manufacturing capacity for mRNA vaccines. More recently, Mandy led the design and development of legislative and regulatory measures to support the Government’s vaping reforms.

 

Mandy has over 20 years’ experience as a legal adviser in the public sector, including at IP Australia, the Australian Pesticides and Veterinary Medicines Authority and the Department of Agriculture, Fisheries and Forestry

 

Jarrod McMaugh 
PSA Victorian State Manager and Pharmacist 

Jarrod McMaugh B.Pharm MPS is the Victorian State Manager for PSA. He has been a pharmacist for 20 years, and has lead the delivery and implementation of smoking cessation services in pharmacies. Jarrod has participated in the delivery of smoking cessation education to health care providers including pharmacist, doctors, and nurses, Since 2017. 

 

Dr Eileen Cole 
GP Lead, Quit (Centre) 

Dr Eileen Cole has been working as the GP Lead in the clinical team at Quit since 2021. Eileen co-developed Quit Centre, an online portal where health professionals can access education, training and resources on providing smoking and vaping cessation care. She works clinically in the student health service at Deakin University, and is a medical adviser for the Department of Health and Aged Care. 

Navigating Vaping Reforms – Interactive Workshops 

From 1 October 2024, therapeutic vapes with a nicotine concentration of 20mg/mL or less will be available in pharmacies to patients 18 years or over without a prescription. Pharmacists will need to be satisfied if it is clinically appropriate, and meet several other conditions, to supply a vape to a patient without a prescription. These changes will help facilitate patient access while maintaining appropriate controls and protections.

    

There’s currently no therapeutic vapes approved by TGA and included on the Australian Register of Therapeutic Goods (ARTG).  Unapproved vapes still have unclear safety and efficacy profiles. As medicines experts, pharmacists are well-positioned to educate the community around evidence-based approaches for smoking cessation and managing nicotine dependence. It’s also essential pharmacists are across these regulatory changes relating to supplying therapeutic vapes, where legitimate patient access to therapeutic vapes are required. 

    

The learning objectives for this workshop are:  

  1. Demonstrate effective communication with the patient, prescriber and any others involved in the management of the patient.   
  2. Discuss ethical and professional responsibilities, particularly considering the current lack of evidence supporting the therapeutic benefits of nicotine vaping products.   
  3. Apply knowledge of legislation and risk assessment, management and mitigation process requirements regarding the nicotine vaping reforms.

The webinars will be recorded and made available on our website for those unable to attend. The workshops will only be available in person. 

I am not a member of the PSA – can I still attend?

Yes, this training is funded by the Australian Government funded and is available for members and non-members of the Pharmaceutical Society of Australia. 

Should I attend both the webinars and the workshops?

You may choose to attend either or both. Webinars and workshops complement each other but are designed to be valuable independently. 

Are CPD points available?

Yes, participants are eligible for Group 2 CPD points.

How much does it cost to attend?

There is no cost to attend. The training is fully funded by the Australian Government. 

Can students attend?

Pharmacy students are eligible to attend the webinars only. 

What if I have questions or concerns about vaping reforms?

During the webinars and workshops, there will be opportunities to ask questions and discuss your concerns with the speakers. You can also reach out to PSA directly for additional support.

Can I attend a workshop in a different state if the timing/location is more convenient for me?

Yes, pharmacists are welcome to attend workshops in any state or region, as long as space is available.
